The Social Security Tribunal falls into three sections:

  1. The Social Security Tribunal
    The SST is an independent an impartial body set up under the Social Security (Jersey) Law 1974.
    This Tribunal considers appeal on decisions made by Determining Officers in the Social Security Department in respect of:
    • Contributory benefits such as Old Age Pension or Short Term Incapacity Allowance;
    • Benefits paid under the Health Insurance (Jersey) Law 1967 and;
    • Decisions and awards of Income Support and/or Long Term Care that are not medical in nature.
    The Tribunal is composed of the Chair or a Deputy Chair with two panel members.
  1. The Social Security Medical Appeal Tribunal
    The SSMAT is an independent and impartial body set up under the Social Security (Jersey) Law 1974.
    This Tribunal considers appeals specifically on the award of Long Term Incapacity Allowance (LTIA) on the following questions regarding loss of faculty for an LTIA claim:
    • Whether a relevant disease or injury has resulted in a loss of faculty;
    • Whether a loss of faculty is likely to be permanent;
    • The degree at which incapacitation resulting from a loss of faculty is to be assessed or;
    • The period to be taken into account in the assessment of the degree of incapacitation resulting from a loss of faculty.
    The Tribunal is composed of the Chair or a Deputy Chair with two licensed medical practitioners.
  1. The Income Support Medical Appeal Tribunal
    The ISMAT is an independent and impartial body set up under the Income Support (Jersey) Law 2007.
    This Tribunal considers appeals based on:
    • Medical grounds affecting a claim to income support including the impairment component, personal care, mobility and GP visits;
    • Home carer’s allowance, whether a carer is regularly and substantially caring for a person, that the person being cared for requires a certain level of personal care;
    • The assessment of care levels for long term care, whether those needs can be met by care delivered in the person’s own home.
    The Tribunal is composed of the Chair or a Deputy Chair with a medical practitioner and a panel member with experience of disability.

 


Who sits on the Tribunal?

All tribunals have a legally qualified chairman to help apply the law to your appeal. 

Tribunal members for Social Security appeals are appointed by the States of Jersey and are completely independent from the Social Security Department. They are experts on the issues involved in your appeal.

 


Submitting an appeal application

If you would like to appeal a decision made by the Social Security Department, please ensure you have asked the Social Security Department for your claim to be reviewed by a different officer or medical board before submitting your appeal. If you are still not satisfied after this redetermination, please complete and submit the appeal form below.
